Terms of Service

1. Who Can Use Whisperly (Adults Only)

• You must be at least 18 years old to access or use Whisperly. Our Service is for adults only.
• By using Whisperly, you represent and warrant that you are 18+ and have the legal capacity to enter into a binding agreement.
• If we believe you are under 18 or otherwise ineligible, we may suspend or terminate your access immediately.

2. Nature of the Service

Whisperly is an anonymous, voice-first chat platform that connects adults for real-time conversations. We do not provide dating, escort, or adult entertainment services, and we do not guarantee any particular outcome from your interactions with other users.

• Conversations are ephemeral and are not intended to be recorded or stored by us.
• You are solely responsible for what you say and how you interact with others.
• We do not verify the identity, age, or background of users, and you interact with others at your own risk.

3. No Minors – Zero Tolerance

We have a strict zero-tolerance policy toward any involvement of minors on or through the Service.

• No one under 18 may use Whisperly for any reason.
• You must not discuss, depict, or attempt to involve minors in any way, including roleplay, stories, or references to sexual activity involving anyone under 18.
• You must not share or request any content involving minors or that could be interpreted as sexualizing minors.
• We may block, ban, and report suspected violations involving minors to law enforcement or appropriate agencies where required or appropriate by law.

4. Prohibited Uses and Content

You agree not to use Whisperly to:

• Break any law or encourage others to do so.
• Harass, threaten, abuse, stalk, or intentionally distress other users.
• Promote or facilitate prostitution, sex trafficking, exploitation, or other criminal activity.
• Share or attempt to share hateful, extremist, violent, or pornographic content.
• Impersonate another person, misrepresent your identity, or mislead others about who you are.
• Send spam, advertisements, or solicitations, including attempts to move users to other platforms for prohibited or commercial purposes.
• Reverse engineer, disrupt, overload, or interfere with the operation or security of the Service.

5. User Safety and Offline Interactions

• We strongly discourage sharing personal information (full name, address, phone number, social accounts, etc.) with strangers.
• If you choose to interact with someone outside Whisperly, you do so entirely at your own risk.
• We are not responsible for what happens in any offline or off-platform interaction between you and other users.

6. Accounts, Guests, and Access

• You may access Whisperly as a guest or through an account if we offer registration.
• You are responsible for keeping any credentials secure and for all activity that occurs under your session or account.
• We may suspend, limit, or terminate your access at any time if we believe you have violated these Terms, risk harm to others, or pose a security or abuse risk.

7. Moderation and Enforcement

• We may use automated tools, logs, and limited session data to help detect abuse and protect users.
• We may review reports, mute or disconnect sessions, suspend accounts, or block devices at our discretion.
• We may share information with law enforcement where we believe it is required by law or necessary to protect someone from serious harm.

8. Privacy

Our use of technical data, logs, and limited metadata is described in our Privacy Policy. By using Whisperly, you agree to that policy.

9. Disclaimers

• No Guarantees: Whisperly is provided on an “as is” and “as available” basis. We do not promise that it will be uninterrupted, secure, or error-free.
• User Responsibility: You are responsible for your own behavior, your safety, and how you choose to use the Service.
• No Professional Advice: Conversations on Whisperly are not professional, medical, legal, or financial advice.

10. Limitation of Liability

• To the maximum extent permitted by law, Whisperly and its owners, team, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service.
• If we are found liable for any claim, our total liability will be limited to the greater of (a) the amount you paid us in the last 6 months (if any), or (b) USD $100.

11. Indemnity

You agree to indemnify and hold harmless Whisperly and its owners, team, and partners from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your interactions with other users; or (c) your violation of these Terms or applicable law.

12. Changes to the Service and Terms

• We may update, change, or discontinue parts of Whisperly at any time.
• We may update these Terms from time to time. When we do, we will update the “Effective Date” at the top of the page.
• If you continue to use Whisperly after changes take effect, you accept the updated Terms.

13. Governing Law

These Terms and your use of Whisperly are governed by the laws of the jurisdiction where Whisperly is operated, without regard to conflict of law rules. Any disputes will be resolved in the courts of that jurisdiction, unless applicable law requires otherwise.
